FRA evaluated the Project in accordance with Section 106 of the National Historic Preservation Act (NHPA) and Section 4(f) of the USDOT Act of 1966
The North River Tunnel and High Line are the only historic properties and 4(f) properties located within 90 feet of construction for the Selected Alternative.
The Project Sponsor will develop a Construction Protection Plan (CPP) to protect the North River Tunnel and High Line.
FRA and NYSHPO determined that operation and construction of the Preferred Alternative would not result in any adverse effects to Section 106 historic properties or Section 4(f) properties with implementation of the CPP.
